Thanks for using ObjectiveFS! We developed ObjectiveFS to make it easy for you to manage your infrastructure so you can focus on your core business.
These terms of service (“Terms”) cover your use and access to the ObjectiveFS software, website and services (“Service”) provided by Objective Security Corp. By using our Services, you’re agreeing to be bound by these Terms, our Software License Agreement and to review our Privacy policy. If you’re using our Services for an organization, you’re agreeing to these Terms on behalf of that organization.
Website password. Please safeguard your password to the Services, make sure that others don’t have access to it, and keep your account information current. We don’t have access to your current password, and for security reasons, we may only reset your password.
Software passphrase. ObjectiveFS software requires the use of a user-supplied passphrase to access stored data. We do not have access to your passphrase and cannot reset it. If this passphrase is lost, there is no way to access your data. Please safeguard and store your passphrase in a safe place.
Our Services are not intended for and may not be used by people under the age of 16. By using our Services, you’re representing to us that you’re over 16.
You agree that you won’t use ObjectiveFS in a way that violates any laws or regulations.
Billing. Our charges for plans are posted on our website and may change from time to time. Our Service is offered with a free trial. Your account will be charged once the free trial is completed, unless you cancel your account before the end of the trial.
We calculate the charges based on “mount points”. A “mount point” is defined as a running copy of ObjectiveFS software. The monthly price is calculated based on the 99th percentile of the maximum concurrent copies of ObjectiveFS software that you run. Backend object store charges, such as Amazon S3 and Google Cloud Storage, are not included in our pricing and are billed separately by Amazon and Google.
Taxes. Charges are exclusive of taxes. You’re responsible for all applicable taxes and government charges,
Plan Change. You can upgrade or downgrade plans at any time, with the change taking effect immediately.
Certain advanced features may be available on your plan for evaluation purpose only. If you have a feature not included in your current plan enabled for more than one month, your plan will be upgraded to a plan that includes this feature. You will be notified by email prior to the plan upgrade and can opt out of the upgrade by discontinuing the usage of this feature.
Proof-of-Concept Plans. Any Proof-of-Concept (POC) plan is only for longer term evaluations and testing. These plans have a limited duration and are not for use in production.
Cancellation. If you no longer wish to use ObjectiveFS, you may cancel at any time. You will continue to have access to your subscription through the end of the current billing period. Please copy your data out from ObjectiveFS before the end of your subscription period, as your data will not be accessible after your subscription has ended.
Changes. We may change the fees in effect but will give you advance notice of these changes via a message to the email address associated with your account.
Notifications. We may contact you by email on subjects related to your account or ObjectiveFS. While your account is active, it is your responsibility to keep your email address current.
Technical Support. You may contact our support team for technical assistance. You are solely responsible for the implementation and results of any suggestions or advice received.
SLA. If you subscribe to an optional SLA support plan, we will use commercially reasonable efforts to (a) respond within the “Response Times” set forth in the ObjectiveFS Production Service Level Agreement for all properly submitted cases from authorized individuals, and (b) work towards the identification and resolution of the problems submitted. When submitting a case, you may designate the severity level of a problem; provided that, we reserve the right to reclassify the severity level in our reasonable opinion. All Response Times are measured from the point when a case has been properly submitted by an authorized individual to us. Cases may be submitted as specified in the SLA case submission document. We do not represent, warrant or guarantee that (i) we will always be able to resolve a case fully, (ii) you will no longer experience a problem, (iii) we will provide a bug fix, patch or other workaround in connection with the identified problem, or (iv) any support or advice will result in any performance efficiency or improvement. You are solely responsible for the implementation and results of any suggestions or advice received.
These Terms will be governed by California law except for its conflicts of laws principles.
These Terms constitute the entire agreement between you and Objective Security Corp. with respect to the subject matter of these Terms, and supersede and replace any other prior or contemporaneous agreements, or terms and conditions applicable to the subject matter of these Terms. These Terms create no third party beneficiary rights.
Objective Security Corp’s failure to enforce a provision is not a waiver of its right to do so later. If a provision is found unenforceable, the remaining provisions of the Terms will remain in full effect and an enforceable term will be substituted reflecting our intent as closely as possible. You may not assign any of your rights under these Terms, and any such attempt will be void. Objective Security Corp. may assign its rights to any of its affiliates or subsidiaries, or to any successor in interest of any business associated with the Services.
We may revise these Terms from time to time, and will always post the most current version on our website. If a revision meaningfully reduces your rights, we will notify you (by, for example, sending a message to the email address associated with your account, posting on our blog or on this page). By continuing to use or access the Services after the revisions come into effect, you agree to be bound by the revised Terms.
